License & Intellectual Property Policy

CineMaster Academy

This License & Intellectual Property Policy is a summary of the intellectual property and licensing rules governing all content sold by CineMaster Academy. It is governed by and fully consistent with Section 12 (Limited License for Digital Downloadable Products) and the intellectual property provisions of Sections 1, 2, and 3 of our Terms of Use, which contain the complete and binding terms. In the event of any conflict between this summary and the Terms of Use, the Terms of Use govern.


1. Intellectual Property Ownership

All courses, Pro Packs, digital assets, LUTs, color-grading presets, sound design libraries, sound effects packs, music tracks, video overlays, photo overlays, motion graphics templates, CGI templates, AI templates, AI prompt packs, PDF guides, e-books, presets, video transitions, plug-ins, scripts, project files, stock assets, design files, video lessons, live session recordings, written materials, and all other content provided by CineMaster Academy (collectively the "Content") are owned by or licensed to CineMaster Academy and are protected by applicable copyright, trademark, and other intellectual property laws, including the U.S. Digital Millennium Copyright Act (DMCA).

All intellectual property rights in and to the Content — including but not limited to copyrights, trademarks, trade secrets, and moral rights — remain the exclusive property of CineMaster Academy and/or its licensors. No ownership rights in any Content are transferred to you by purchase, download, access, or use. Your rights are limited to the license terms set forth in this Policy and in Section 12 of the Terms of Use.


2. Two Distinct License Types

CineMaster Academy grants two distinct types of license depending on what you purchased. These two licenses operate differently and have different termination conditions.

(A) Course License — granted to active, paid students of CineMaster Academy courses. This license is tied to your active enrollment and terminates upon refund, account termination, or other events described in Section 5 below.

(B) Pro Pack License — granted upon purchase of any Pro Pack or other digital downloadable Product. This license is permanent under Section 12.5 of the Terms of Use ("Lifetime Access"), subject to your continued compliance with these Terms. Pro Pack licenses are not terminated by inactivity, lack of future purchases, or cancellation of any unrelated subscription.


3. Course License Terms

While you are an active, paid student of a CineMaster Academy course and have not requested or received a refund, CineMaster Academy grants you a limited, non-exclusive, non-transferable, non-sublicensable, royalty-free license to access, view, and use the course Content for the following permitted purposes:

Personal educational use, study, and review;

Practice and application of the techniques taught in your own creative work;

Use of any course-provided downloadable assets (where applicable) in your own creative projects, including commercial and client work, subject to the same restrictions that apply to Pro Pack assets under Section 4 below.

This license is personal to you. It does not extend to any other person, company, or entity. The course license terminates immediately upon any of the events described in Section 5.


4. Pro Pack License Terms

Upon successful purchase of a Pro Pack, CineMaster Academy grants you a limited, non-exclusive, non-transferable, non-sublicensable, worldwide, royalty-free license to use the Pro Pack assets for the following permitted purposes:

(a) Personal use in your own creative projects;

(b) Commercial use in your own original creative projects (such as videos, films, photography, podcasts, social media content, brand content, advertising, or other creative works produced by you or your business); and

(c) Use within your own client work, where the Pro Pack assets are integrated into deliverables created for your clients.

This license is granted on a permanent basis (lifetime access), subject to your continued compliance with these Terms. "Lifetime" refers to the lifetime of the Pro Pack Product as offered on the Site and does not refer to your personal lifetime or to any guaranteed continuation of the Company's business operations. See Section 12.5 of the Terms of Use for complete lifetime access and updates terms.


5. Prohibited Uses (All Licenses)

Regardless of which license you hold (Course License or Pro Pack License), you expressly agree NOT to do any of the following with any CineMaster Academy Content:

(a) Resell, redistribute, sublicense, or transfer the Content or any individual asset to any third party;

(b) Include the Content in any stock library, marketplace, asset pack, template store, or other product offered for sale or free download to third parties;

(c) Share, gift, lend, or otherwise distribute the Content files, course access, or login credentials with any other person;

(d) Upload the Content to any cloud storage, file-sharing service, peer-to-peer network, torrent service, or similar distribution platform in a manner that allows third-party access;

(e) Create derivative products that compete with CineMaster Academy's offerings (for example, reselling LUTs you have slightly modified from a purchased Pro Pack, or republishing course material as your own training);

(f) Use the Content in ways that would violate applicable laws, including without limitation copyright, trademark, defamation, privacy, publicity, or obscenity laws;

(g) Reverse-engineer, extract, decompile, or otherwise attempt to derive source files from any Content asset for the purpose of reselling or redistributing the underlying components;

(h) Screen-record, screen-capture, audio-record, video-record, or otherwise reproduce by any recording means any portion of CineMaster Academy's courses, modules, lessons, live sessions, coaching calls, Q&A sessions, community discussions, member areas, or any other Content delivered through the Site — regardless of the means used (including without limitation built-in operating system recording tools, third-party recording or capture software, secondary cameras or recording devices, mobile phones, or any other method); and

(i) Claim authorship, ownership, or original creation of any CineMaster Academy Content, in whole or in part.

Content may be used only as part of your own creative projects or, in the case of a Course License, for your personal educational use. CineMaster Academy Content may not be used as standalone resale assets, repackaged training, or competing products.


6. License Termination

Your license to use CineMaster Academy Content terminates immediately upon any of the following events:

For Course Licenses:

You request and receive a refund on a course, in accordance with Section 11 of the Terms of Use;

Your account is terminated for cause under Section 14 of the Terms of Use (including violations of these Terms, wrongful chargebacks, or unauthorized use of Content);

You cancel or fail to maintain payment on any active payment plan associated with the course, until the balance is restored.

For Pro Pack Licenses:

You violate any provision of Section 5 (Prohibited Uses) of this Policy or any provision of Section 12 of the Terms of Use;

You receive a discretionary refund under Section 11.5 of the Terms of Use (limited cases such as verified duplicate purchase, verified technical delivery failure, or unauthorized purchase);

Your account is terminated for cause under Section 14 of the Terms of Use.

Upon license termination:

All rights to use the Content end immediately;

Continued use, reproduction, distribution, or display of any Content becomes unauthorized and constitutes infringement;

You must immediately cease all use of any Content downloaded prior to termination, including deleting copies from your devices and storage.


7. Zero Tolerance for Unauthorized Use

CineMaster Academy maintains a strict zero-tolerance policy against unauthorized sharing, redistribution, resale, screen-recording, or any other exploitation of its Content. Unauthorized use includes, but is not limited to:

Sharing files, links, or credentials with any other person;

Uploading Content to websites, forums, social media, cloud storage, or peer-to-peer networks in a manner that allows third-party access;

Reselling, sublicensing, or redistributing Content in any form;

Screen-recording or otherwise reproducing course or live session content;

Using Content after a refund, account termination, or other license termination event;

Creating derivative or competing products from CineMaster Academy Content.


8. Enforcement

CineMaster Academy actively monitors for copyright infringement and unauthorized use of its Content. If violations are identified, CineMaster Academy may take any of the following enforcement actions, alone or in combination, at its sole discretion:

Issuance of DMCA takedown notices to hosting providers, social media platforms, marketplaces, and content delivery networks;

Cease-and-desist demands directed to infringing parties;

Immediate revocation of your access to all CineMaster Academy Products without refund;

Permanent account termination under Section 14 of the Terms of Use;

Reporting of the violation to fraud-prevention databases and, where permitted by law, to credit-reporting agencies;

Pursuit of civil legal remedies, including recovery of actual damages, statutory damages under copyright law, injunctive relief, and reasonable attorneys' fees and costs; and

Pursuit of any additional remedies available under applicable U.S. federal, state, or international law.


9. Consequences of Violation

Violations of this Policy or Section 12 of the Terms of Use may result in:

Permanent loss of access to all CineMaster Academy Products, including any Content previously purchased;

Immediate termination of all licenses and usage rights, without refund;

Permanent ban of your email address, payment instruments, and any associated accounts from making future purchases from CineMaster Academy;

Civil and, where applicable, criminal liability for copyright or trademark infringement;

Liability for damages, including lost profits, statutory damages under U.S. copyright law (up to $150,000 per work for willful infringement under 17 U.S.C. §504), and the Company's reasonable attorneys' fees and costs.


10. Reporting Infringement (DMCA Notice Procedure)

If you believe CineMaster Academy Content is being used unlawfully by a third party, or if you believe any content on the CineMaster Academy Site infringes your own intellectual property rights, please submit a written notice including the following information to [email protected]:

Your full name, mailing address, telephone number, and email address;

A description of the copyrighted or proprietary work you believe is being infringed (or, for inbound notices, the work that allegedly infringes yours);

The location (URL, platform, or other identifier) where the alleged infringement is occurring;

Relevant copyright, trademark, or other intellectual property registration information, where applicable;

A statement of your good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;

A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the rights holder; and

Your physical or electronic signature.

Notices not satisfying these requirements may not be actionable.


11. Statutory Consumer Rights

Nothing in this Policy affects any non-waivable statutory consumer rights you may have under applicable consumer-protection or copyright laws in your jurisdiction. Where a statutory right conflicts with this Policy, the statutory right prevails to the extent required by law.


12. Governing Law and Dispute Resolution

This Policy is governed by the laws of the State of Nevada, United States, without regard to conflict-of-law principles, and by applicable U.S. federal intellectual property law. Any dispute arising under this Policy is subject to the binding arbitration, class action waiver, and 30-day opt-out provisions set forth in Section 17 of the Terms of Use, except that claims by CineMaster Academy seeking injunctive relief to prevent unauthorized use of its intellectual property are not subject to mandatory arbitration and may be brought in court (see Section 17.4(b) of the Terms of Use).


13. Updates to This Policy

CineMaster Academy reserves the right to modify this License & Intellectual Property Policy at any time and in its sole discretion. Modifications apply only to Content purchased or accessed on or after the effective date of the modification; the version of this Policy in effect at the time of your purchase governs your existing license. The "Last Updated" date at the top of this page indicates the current version.
