CineMaster Academy

This Pro Packs Refund Policy is a summary of the refund rules governing Pro Packs and other digital downloadable Products sold by CineMaster Academy. It is governed by and fully consistent with Section 11 (Refund Policy) and Section 12 (Limited License for Digital Downloadable Products) of our Terms of Use, which contain the complete and binding terms of your purchase. In the event of any conflict between this summary and the Terms of Use, the Terms of Use govern.

1. Scope

This policy applies only to Pro Packs and other digital downloadable Products purchased through the CineMaster Academy website. It does not apply to online courses, Pro Tier courses, mentorship programs, live events, or any other Product category, each of which is governed by its own separate refund terms as set forth in Section 11 of the Terms of Use.

2. What Qualifies as a Pro Pack

Pro Packs are digital downloadable Products delivered electronically with immediate access upon purchase. The Pro Pack category includes, without limitation:

LUTs and color-grading presets;

Sound design libraries, sound effects packs, music tracks, Foley sounds, and ambient soundscapes;

Video overlays and photo overlays;

Motion graphics templates and CGI templates;

AI templates and AI prompt packs;

PDF guides and e-books;

Video transitions, plug-ins, scripts, and project files;

Stock assets and design files; and

Any other instantly-deliverable digital file sold through the Site.

3. All Pro Pack Sales Are Final

Due to the digital nature of Pro Packs and immediate delivery upon purchase:

All Pro Pack sales are final.

No refunds, returns, or exchanges are offered, except as described in Section 5 below.

Once access or download is provided, the Product is deemed delivered.

Industry-standard practice for digital downloadable Products is final sale, because once a file has been delivered, it cannot be returned, recovered, or unmade.

4. Customer Acknowledgment at Checkout

By completing a Pro Pack purchase, you expressly acknowledge and agree that:

You are purchasing a digital product with immediate delivery;

Pro Packs are non-refundable except as described in Section 5;

You waive any right to a refund, return, or exchange for this purchase, except as required by non-waivable statutory consumer rights in your jurisdiction;

For customers located in the European Union, United Kingdom, or other jurisdictions with statutory cooling-off periods for digital content, you expressly consent to immediate delivery of the digital content and acknowledge that you thereby waive your statutory right of withdrawal, in accordance with Section 11.12 of the Terms of Use.

This acknowledgment is required at checkout via the Terms of Use acceptance checkbox and forms part of the purchase agreement.

5. Limited Discretionary Exceptions

Pro Packs are sold as final sale with no refunds. However, in limited cases, the Company may, at its sole and absolute discretion, issue a refund or store credit for the following narrowly-defined situations:

(a) Verified Duplicate Purchase: You can demonstrate, with verifiable order records, that the same Pro Pack was accidentally purchased twice within a short timeframe (typically within seven (7) days of the original purchase);

(b) Verified Technical Delivery Failure: You can demonstrate that the Pro Pack file(s) failed to deliver, are corrupted beyond use, or cannot be downloaded due to a technical fault on the Company's side, AND the Company is unable to resolve the delivery issue within a reasonable timeframe;

(c) Unauthorized Purchase: You can demonstrate that the purchase was made fraudulently or without authorization (e.g., by an unauthorized family member or compromised payment method), subject to verification.

To request a discretionary exception under this Section, contact [email protected] within seven (7) calendar days of the qualifying event with full supporting documentation. Approval of any discretionary exception is at the sole and absolute discretion of the Company and is not a guarantee of refund. The Company may, in its discretion, offer store credit, a replacement product, or other resolution in lieu of a monetary refund.

Outside of these narrowly-defined exceptions, all Pro Pack sales are final regardless of reason, including but not limited to: change of mind, dissatisfaction with the Product, failure to use the Product, lack of technical compatibility with the customer's software or hardware (where compatibility was disclosed at the time of purchase), or misunderstanding of what the Product contained.

6. Lifetime Access and Updates

Where a Pro Pack is marketed as including "lifetime access" and/or "free updates," those terms are defined in Section 12.5 of the Terms of Use. In summary: "Lifetime Access" refers to the lifetime of the Product as offered on the Site; "Free Updates" means that, when and if the Company in its sole and absolute discretion releases additional files or updated versions of a Pro Pack you have previously purchased, you will receive those files at no additional cost. The Company makes no commitment regarding the frequency, timeframe, quantity, scope, or substance of any update, and is under no obligation to release updates. The absence of any update, or any delay in releasing an update, does not constitute a breach, a misrepresentation, or grounds for any refund, claim, chargeback, or compensation.

7. Pricing

The price applicable to your Pro Pack purchase is the price disclosed at checkout at the time you completed your order. Price modifications, whether increases or decreases, apply only to purchases made on or after the effective date of the modification. Customers who purchased a Pro Pack prior to a price modification are not entitled to a refund of any price difference and are not entitled to additional content based on subsequent price changes. 8. Chargebacks and Payment Disputes

You agree to contact [email protected] first to attempt resolution before filing any chargeback or payment dispute with your bank, credit card company, or payment processor. Most concerns can be resolved promptly through direct communication.

A chargeback filed in violation of this Pro Packs Refund Policy or the Chargeback Policy set forth in Section 13 of the Terms of Use will be considered a wrongful chargeback and may result in:

Immediate and permanent revocation of access to all CineMaster Academy Products;

Permanent ban of your email address and payment instruments from future purchases;

Recovery of the disputed amount, chargeback fees, collection costs, and attorneys' fees through debt collection or legal action; and

Submission of this policy, your checkout acknowledgment, delivery records, and access logs as evidence to the payment processor.

9. Limited License

Pro Packs are sold under the limited license set forth in Section 12 of the Terms of Use. This license grants you the right to use Pro Pack assets in your own creative projects (personal and commercial) and in client deliverables, but prohibits redistribution, resale, sharing of files or credentials, inclusion in stock libraries or competing products, and screen-recording or other reproduction of Site Content. Violation of the license results in immediate termination of your license without refund.

10. Statutory Consumer Rights

Nothing in this Pro Packs Refund Policy affects any non-waivable statutory consumer rights you may have under applicable consumer-protection laws in your jurisdiction (including the EU Consumer Rights Directive 2011/83/EU and similar laws in the United Kingdom, Australia, Canada, and elsewhere). Where a statutory right conflicts with this Policy, the statutory right prevails to the extent required by law. See Section 11.12 of the Terms of Use for the full statutory rights and digital content waiver provisions.

11. Governing Law and Dispute Resolution

This Policy is governed by the laws of the State of Nevada, United States, without regard to conflict-of-law principles. Any dispute arising under this Policy is subject to the binding arbitration, class action waiver, and 30-day opt-out provisions set forth in Section 17 of the Terms of Use. By making a Pro Pack purchase, you acknowledge and agree to those dispute-resolution provisions.

12. Updates to This Policy

The Company reserves the right to modify this Pro Packs Refund Policy at any time and in its sole discretion. Modifications apply only to purchases made on or after the effective date of the modification; the version of this Policy in effect at the time of your purchase governs your purchase. The "Last Updated" date at the top of this page indicates the current version.
